1. Acceptance of Terms

By accessing and using SwiftUI Gallery (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

SwiftUI Gallery is a marketplace for developers to share, sell, and buy SwiftUI work. Users can upload their work and offer it for sale or share it for free.

3. User Accounts

You must create an account to use certain features of the Service.
You are responsible for maintaining the confidentiality of your account and password.
You agree to provide accurate and complete information when creating your account.
To register a ‘Creator’ account, you must be at least 18 years old.

4. Content Submission and Ownership

By submitting content to the Service, you retain all ownership rights to your content.
You grant SwiftUI Gallery a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Service.
Any content you upload will be considered non-confidential and non-proprietary.
You are responsible for ensuring your content doesn't infringe on any third-party rights.
You warrant that you have the necessary authorization to upload content and will indemnify us for any breach of this warranty.
We have the right to remove any content if necessary to protect our business.

5. Selling and Buying on the Platform

Sellers may offer their SwiftUI work for sale or for free on the Service.
SwiftUI Gallery will charge a fixed rate fee of 5% on all sales (excluding payment processing fees and taxes).
Sellers are responsible for setting their prices and describing their work accurately.
Buyers agree to pay the listed price for any work they purchase.

6. Payments, Fees, and Taxes

SwiftUI Gallery uses third-party payment providers to handle all transactions.
Sellers will receive payment for their sales, minus the platform fee, payment processing fees, and applicable taxes.
SwiftUI Gallery charges a 5% platform fee on all sales.
Payment processing fees are set by our payment providers and may vary.
Sellers are responsible for any taxes on their income from sales.
Buyers may be charged sales tax or VAT depending on their location and local laws.
SwiftUI Gallery is not responsible for calculating, collecting, reporting, or remitting taxes for sellers or buyers.
By using SwiftUI Gallery, you agree to be bound by the terms of any third-party payment providers associated with the Platform.

7. Intellectual Property

Users retain all intellectual property rights to their submitted work.
Buyers receive a license to use purchased work as specified by the seller.
SwiftUI Gallery respects intellectual property rights and will respond to notices of alleged copyright infringement.

8. Prohibited Activities

Users agree not to:

Upload malicious code or content that infringes on others' rights.
Attempt to gain unauthorized access to other users' accounts or the Service's systems.
Use the Service for any illegal activities.
Engage in activities prohibited by Stripe's acceptable use policy.
Upload content unrelated to SwiftUI.

9. Limitation of Liability

To the fullest extent permitted by applicable law, SwiftUI Gallery and its affiliates, officers, employees, agents, partners, and licensors will not be liable for:

a) any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if SwiftUI Gallery has been advised of the possibility of such damages), resulting from your use of the Service;

b) any amount, in the aggregate, in excess of the greater of (i) the amount you have paid SwiftUI Gallery in the six (6) months prior to the event giving rise to your claim or (ii) $100 USD;

c) the cost of procurement of substitute goods or services;

d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party;

e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.

This limitation of liability section applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if SwiftUI Gallery has been advised of the possibility of such damage.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. SwiftUI Gallery expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

SwiftUI Gallery makes no warranty that: a) the Service will meet your requirements; b) the Service will be uninterrupted, timely, secure, or error-free; c) the results that may be obtained from the use of the Service will be accurate or reliable; d) the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any significant changes. Your continued use of the Service after such modifications constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of U.S., without regard to its conflict of law provisions.
